Rental Terms and Conditions – Marbella Banús
1. THE CONTRACT
The holiday rental agreement is entered into between the guest (individual or business) and Marbella Banús – Garu Ventas y Alquileres SLU. It comes into effect once:

The reservation is confirmed in our system, and

50% of the total cost has been paid upon booking, with the remaining 50% due 30 days before arrival.
If the booking is made via portals such as Booking.com or Airbnb, their payment terms shall apply.
This contract is governed by Spanish law, and both parties agree to submit exclusively to the jurisdiction of the courts of Marbella, waiving any other jurisdiction.
2. PAYMENT TERMS
Timely payment is essential to confirm your reservation. Failure to pay the final balance within the stipulated timeframe will result in automatic cancellation with no refund of any amounts already paid.
3. CANCELLATION / CHANGES / REFUNDS
By the guest:

More than 60 days before arrival: full refund minus 2% administrative fee.

Between 59 and 30 days before arrival: forfeiture of 50% of the rental cost.

Within 30 days of arrival: no refund of the rental fee. Cleaning and extras may be refunded if no costs have been incurred.
Name changes accepted with at least 48 hours’ notice. Date changes are permitted only with 60 days’ notice; thereafter, cancellation fees apply.
By Marbella Banús:
If we must cancel due to circumstances beyond our control, we will offer a replacement property of equal or better quality or a full refund.
4. THE PROPERTY
Descriptions and images on our website accurately reflect the property. Minor changes, such as appliance replacements, may occur and are not subject to compensation.
5. MAXIMUM OCCUPANCY
All properties have a strict maximum occupancy limit:

Exceeding the limit without prior notification will result in immediate eviction with no refund.

If the number of guests is higher but within the legal limit, you must inform us at least 24 hours before arrival or face a €50 per person, per night surcharge.
6. PETS
Pets are not permitted without express written consent. Unauthorised animals will result in immediate eviction without refund.
7. CHECK-IN AND CHECK-OUT
Early check-in or late check-out cannot be guaranteed until the day before arrival/departure. We reserve these times for last-minute requests and don’t respond to repeated enquiries.
Penalties apply for unauthorised late departures: €50 + VAT per hour (minimum one hour). Entry during cleaning hours is prohibited.

9. KEYS AND ACCESS MANAGEMENT
Two sets of keys are provided. Guests are responsible for their safekeeping:
Guests are expected to act with common sense; our team must prioritise urgent matters.
10. LINEN AND TOWELS
Included per booking:

Bed linen (one set per bed, plus duvet cover, pillow, mattress and pillow protectors)

Towels (one set per person)
All items must be returned in good condition. Damage or excessive dirt may lead to replacement or cleaning charges.
11. CLEANING AND CHECK-OUT PROCEDURE
Before departure, please:

Tidy the property, ventilate rooms, switch off all devices

Close all windows and doors

Dispose of rubbish in designated public bins

Avoid leaving waste inside. Any found will be charged at €200 + VAT
Check-out instructions will be emailed 48 hours prior.
12. RIGHT OF ENTRY
We may enter the property with 24 hours’ notice. In emergencies (water leak, electrical fault, security issues), we reserve the right to enter without notice.
13. LOST PROPERTY
We are not responsible for personal belongings left behind. Please contact us immediately to arrange collection.
14. SECURITY DEPOSIT
A hold will be placed on your card the day before arrival, released within 7 days of departure, provided no damage is found.
Managed by Stripe; holds can be re-authorised for stays over 7 days.
15. COMPLAINTS PROCESS
Official complaint forms (“Hojas de Reclamaciones”) are available on request.
16. INSURANCE
Marbella Banús acts as an intermediary and does not own the properties. We strongly recommend travel insurance to cover cancellations, medical emergencies, theft, or personal injuries.
